Zyprexa

Eli Lilly and Co. said late Thursday, June 9, 2005 that it has entered into an agreement in principle to settle about 8,000, or 75%, of the claims against the company related to its schizophrenia medication, Zyprexa.

The agreement involves claimants who asserted they developed diabetes-related conditions from their use of Zyprexa.

At this time, Pulaski & Middleman, LLC represents more than 1100 individuals who developed diabetes or pancreatitis while using Zyprexa. Over 700 of those cases have been settled.

Zyprexa, used to treat schizophrenia, bi-polar, ADHD and other mental disorders, has been linked to diabetes and diabetes related complications including coma and death.

Researchers at Duke University found abnormalities in the blood sugar of patients taking Zyprexa. These findings included mild elevations in blood sugar (hyperglycemia), onset of diabetes, and diabetic ketoacidosis. Ketoacidosis associated to Zyprexa adverse effects reports has been fatal in about half of the cases.

Other studies by the Department of Veterans Affairs at Boston University and the University of Illinois at Chicago revealed similar findings. A study conducted on three antipsychotic drugs, including Zyprexa, linked the drug to an increased rate of diabetes and other serious diabetic conditions, such as diabetic coma, caused by severe insulin deficiency.

Zyprexa and the FDA

Since its approval by the Federal Food and Drug Administration in 1996, there have been almost 300 cases of diabetes in patients taking Zyprexa and 23 deaths. Zyprexa, manufactured by Eli Lilly, is one of their top-selling drugs and its sale accounts for about 40 percent of its $11 billion annual earnings.

Zyprexa has been prescribed to over 6 million people world wide. In other countries, the Zyprexa concerns have been so great that Japan and the European Union required that diabetes warnings be added to the Zyprexa label. In the U.S. , however, no such warning has been added to Zyprexa's label.

Each state has a law which limits the amount of time an injured person has to file a lawsuit after the injury. The amount of time can vary greatly for many reasons.
